These General Terms and Conditions govern access to and use of the nanoHexalia ecosystem whenever a website, subdomain, product, application, software, API, service, research activity or training program refers to them. Product-specific terms, orders, proposals, contracts, licenses, SLAs, DPAs or program terms may supplement these terms.
Effective date: 2026-09-27 · Version: 2026-09-27.1
1. nanoHexalia and ecosystem scope
nanoHexalia operates as a Research Center, Software Factory and Education and Training Center. Its offering may include software products, artificial intelligence, automation, analytics, consulting, technical services, applied research, development and innovation, training and related solutions.
2. Order of precedence
Mandatory applicable law prevails over any agreement. Thereafter, as applicable, the contract, order, accepted proposal, data-processing agreement, SLA or specific license applies; then product- or program-specific terms; and finally these general terms and the cross-cutting privacy and data-processing policies. Specific terms modify these terms only with respect to the matter they expressly govern.
3. Eligibility, accounts and credentials
Where a service requires an account, the user must provide reasonably accurate information, keep credentials secure and report unauthorized access. Business accounts may be administered by the customer organization and subject to permissions it defines.
4. Permitted use and restrictions
- Use services lawfully and in accordance with applicable documentation and terms.
- Do not interfere with security, availability, integrity, access controls or operation.
- Do not introduce malware, stolen credentials, unlawful content or data the user has no right to process.
- Do not attempt unauthorized access to systems, accounts, information or restricted capabilities.
- Do not use a solution to infringe third-party rights or violate legal or contractual obligations.
5. User-provided content and data
Users retain the rights they hold in information and content they provide. By using a solution, users grant nanoHexalia the technical permissions needed to host, process, transform, transmit or display that content only to the extent required to provide, secure and support the service or fulfill an additional validly agreed purpose.
The user represents that they have sufficient rights, permissions and lawful grounds to provide and process information submitted to the service.
6. Artificial intelligence and automated outputs
Some products may use AI, generative models, classifiers, recommendation systems or automation. Their outputs may contain errors, omissions or uncertainty and should be evaluated according to context, source and decision impact. Where a decision may have significant effects, the user must apply appropriate human review and controls.
Unless specifically agreed otherwise, an AI output does not by itself constitute legal, medical, financial or other regulated professional advice.
7. Research, prototypes, beta features and experimentation
Research activities, prototypes, pilots, tests or beta features may have limited scope, change during evaluation or be withdrawn. Where an activity has specific conditions, they will be disclosed before participation or included in the applicable agreement.
8. Education and training
Education or training programs may establish requirements for access, attendance, assessment, certification, intellectual property in materials and conduct. A record or certificate evidences only what the program expressly states and does not constitute a professional license or third-party certification unless expressly indicated.
9. Intellectual property
nanoHexalia trademarks, software, code, interfaces, documentation, methodologies, content, training materials, designs, models, knowledge bases and other assets are protected by applicable rights. Access to a service does not transfer ownership. Any license or permission is limited to the expressly agreed scope.
Third-party or open-source components are governed by their respective licenses.
10. Confidentiality
Where a relationship involves confidential information, the parties must protect it according to the applicable contract, its nature and reasonably expected safeguards. These terms do not replace a specific confidentiality agreement where one is needed.
11. Third-party providers and services
Services may integrate with or depend on infrastructure, models, APIs, payment gateways, communications or other third-party technologies. Third-party terms may apply to their own services. nanoHexalia selects and integrates providers according to solution needs but does not have absolute control over the availability or changes of external platforms.
12. Pricing, payments, taxes and promotions
Applicable prices, taxes, currency, scope, payment method, offer validity and commercial terms are those published or agreed for each product or service at the relevant time. Promotions are temporary and apply only during their stated validity and specific conditions; an expired promotion does not become a permanent part of these general terms.
13. E-commerce and consumer rights
Where a relationship constitutes consumer or e-commerce activity in Colombia, applicable mandatory rights and obligations will be respected, including information duties, evidence of acceptance, support mechanisms, withdrawal rights, payment reversal and other protections where legally applicable. Nothing in these terms is intended to exclude non-waivable consumer rights.
14. Electronic contracting and evidence
Acceptances, orders, forms, electronic records, data messages and other digital mechanisms may be used to document interactions and agreements as permitted by applicable law. nanoHexalia may retain reasonable technical evidence of acceptance, terms version, date, user, transaction or event where relevant.
15. Availability, maintenance and changes
We may perform maintenance, security fixes, updates and product changes. Specific availability or support commitments exist only where expressly set out in a contract or SLA. We seek to avoid unnecessary disruption and to communicate material changes where appropriate.
16. Suspension and termination
Access may be suspended or limited where necessary for security, maintenance, material breach, risk to third parties, legal obligations or non-payment, in accordance with applicable specific terms. Termination does not affect obligations that by their nature are intended to survive.
17. Warranties and liability
nanoHexalia will provide services with the scope and level of care reasonably required under the applicable agreement. General website descriptions do not by themselves guarantee a specific outcome. Any limitation of liability must be read together with the applicable contract and does not affect rights that cannot lawfully be limited.
18. Data protection
Personal-data processing is governed by the Privacy Policy, the Personal Data Processing Policy and, where applicable, specific data-processing agreements or privacy notices.
19. Governing law, language and disputes
Unless a specific agreement validly provides otherwise, these terms are interpreted under the laws of the Republic of Colombia. The parties will seek in good faith to resolve disputes through agreed support channels and mechanisms before resorting to competent authorities or forums.
The ES and EN versions are intended to express the same scope. In the event of a material discrepancy in a relationship governed by Colombian law, the Spanish version prevails unless specifically agreed otherwise.
20. Changes and contact
We may update these terms to reflect regulatory, technological, operational or offering changes. The current version and effective date will be published on this page. General contact: [email protected]. Privacy and data protection: [email protected].
